Creating a valid will is 3 step process:

  1. Confirm that the person making the will has capacity to make a will.

#1 Confirm that the person making the will has capacity

  2. The individual suffers from a mental health disorder with symptoms including delusions or hallucinations that result in giving property in such a way that they would not have done without the delusions or hallucinations
